well actually, i was hoping you would enlighten me...it'd help if you answered my legitimate and i hope, civil..post about your take on constitutional amendments..at least then i would have something to work with...something specific to respond to....

i told you i don't disagree with the constitution...so it really is a question of interpretation of a framework document, in a modern world....

i'll need an answer to my query though...so if you would be so kind...

There is no framework to work with. The United States Constitution is what it is. As for me and my view, the Amendments, the originals, were not necessary but we have them so we must follow them.

What we need in the Federal government is for them to follow the Constitution as it was written not what a judge says it says for their own edification.

As for a "modern world" the Constitution stands on its own footing.

well if it wasn't a framework, there would be no need for any amendments at any time...if every aspect of american life as we know it, was completely contained within the 4 corners of a 4 page document written in the late 1700's, we'd not need any amendment...ever..

but of course it's a founding document, born of revolution, to set up a new system of government and deals in generalities and cant possibly address the myriad issues we all wrestle with..

there are certainly aspects of the constitution which are timeless and essential for a functioning orderly and fair society...free speech being an example...it's pretty unequivocal and not really open to any interpretation..

but the second amendment...is indeed open to interpretation...and that makes sense..it was written at a time of no standing army, no national guard, no fbi, no organized local police forces

the people WERE the law and order..there was a bona fide fear of governemnt take over as a revolution to throw off the yokes of a colonial government, had just taken place..

so given the historical context...a time of flintlocks and insurrection..it made perfect sense to have the second amendment..

but if you're 2010 strict interpretation that the constitution as it was written was sacrosanct..then why can't i own landmines, 3 rocket launchers and a sherman tank?

they are arms..i want to be armed..i have the right to bear them....it's in the constitution...nuff said...

or should i be able to?...

Wrong. It is not up to interpretation, period. And, yes, we should be able to own any arms we so feel like owning. That is what the Second Amendment is all about. However, the federal government has taken it upon themselves to tell YOU what you can and cannot own and that cannot be when one takes the Second Amendment for what it is worth...everything.

The federal government is afraid because they cannot own us all. That is where Revolutions stem from.

so just to make sure i am getting it right here...landmines, rocket launchers, tanks, etc..any and all ordnance existing in the world today, should be freely available for ownership by any american citizen?...

so to take it to a somewhat ridiculous extreme, but only as ridiculous as a strictly literal and un-amendable reading of the second amendment...the following scenario would meet with your approval?

american citizens, but also zealously fundamentally muslim ..form a militia.. amass an arsenal of everything from rocket propelled grenades to 50 cal machine guns to anti personel mines to stinger missiles, with impunity?

and furthermore, it is your absolute belief that the founding fathers of the mid 1700's...a time of muskets ..in a predominantly christian culture..were so forward thinking as to anticipate a scenario like mine and still figgered they'd pen the second amendment as it stands now, anyway?..

do i have that right?

it's an odd interpretation of "not getting it"...how would following the constitution preclude practitioners of a particular religion or political and/or cultural belief system?...isn't that, in fact, exactly what to constitution was designed to do?.. with freedom of speech, freedom of religion, freedom to believe whatever you want?
